The Ownership Transfer Process

The following is an explanation of the typical ownership transfer process when you purchase a property from us. This process may vary depending on the locality of the property and the specific terms of the contract.The Initial PaymentWhen purchasing a property from us, the first step is to make an initial payment through the property page on our website. This is a deposit, or earnest money, which will reserve the property for you until final payment is made. We will acknowledge the receipt of your payment, usually via email.The ContractWe will email a two-page contract to you for review. Review the contract carefully and let us know if there are any errors, questions, or if you require any contingencies in the contract.After both parties have signed the contract, it will be forwarded to an escrow/title company that is local to the property. As a trusted third party, the escrow company will facilitate the transaction for both parties.Escrow and TitleThe title company will produce a preliminary title report for review. This will specify all the conditions that must be met in order for them to issue a title insurance policy to you as the new owner.The escrow/title company will also provide instructions to both parties in the transaction regarding any documents that they require in order to issue title insurance, comply with government regulations, and so on.You will need to notify the escrow/title company how you wish to hold title (e.g. joint tenants, tenants in common).Costs, Fees, and TaxesIf there are any property taxes due or delinquent, we will pay them fully. Why Deeds are Recorded

DeedsReal estate deeds are the legal documents that transfer ownership between two parties. There are various types of deeds used for different purposes. Deeds are usually used when a property is sold; however, they can also be used at any other time to add or remove a person from the title, or to make other amendments.RecordingRecording (or filing) a deed provides "constructive notice" to the public that a transaction, or some other change, has taken place. Each county or borough in the United States has some type of land records system. Typically, the county clerk, recorder or registrar maintains the database of property records. After a real estate deed is filed or recorded, the original is returned to the grantee.Why Recording is ImportantTechnically, a transfer of property ownership is effective as soon as the deed is signed by the grantor. However, if a deed is not filed on public record, complications could arise in the future.Filing a deed on public record alters the chain of title to show the grantee as the legal owner. Mortgage lenders require deeds to be recorded in order to obtain a title insurance policy. Additionally, county property tax collectors use the names on the most current deed on record to bill the correct owner.If a deed is not recorded, knowledge of the transaction may reside only with the parties involved. This can create a missing link in the property's chain of title, opening the possibility of future disputes or discrepancies regarding true ownership.

Owner Financing
